Terms and Conditions

NO PURCHASE, DONATION, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.  A PURCHASE, DONATION, OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF BEING SELECTED AS WINNER.  Contest entry period begins at 12:00:00 AM on Friday, September 2, 2023, and ends at 11:59:59 PM on Friday, October 20, 2023. Only those who will be present on St. Thomas, USVI can enter.

Nana Baby Children’s Home is the host of this contest (the “Host”), which invites participants to submit an entry form and provide tacos at the Battle of the Bands Tunes and Taco Throwdown 2023. 

PLEASE NOTE THAT THE SUBMISSION, WHICH INCLUDES ANY MATERIALS YOU SUBMIT WITH YOUR SUBMISSION, MAY BE MADE PUBLIC BY SPONSOR, INCLUDING ON THE INTERNET.  BY SUBMITTING A SUBMISSION, YOU GRANT SPONSOR A LICENSE TO SHARE, REPUBLISH AND USE YOUR SUBMISSION AS SET FORTH IN THESE TERMS & CONDITIONS.  YOU SHOULD NOT SUBMIT ANY MATERIALS IN YOUR SUBMISSION THAT YOU DO NOT WANT, OR DO NOT HAVE THE RIGHT, TO BE MADE PUBLIC. 

Eligibility: This Campaign is open only to those who sign up at nanababyhome.com/events. Employees of Nana Baby Children’s Home, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Campaign. The Campaign is subject to all applicable Virgin Islands laws and regulations.

Agreement to Rules: By participating, the Contestant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Nana Baby Children’s Home final and binding as it relates to the content of this Campaign.

How to Enter: In the message section of the entry form above, please provide your name as you would like it advertised. Also note the division(s) you will be entering (meat, veggie, fish). Once you receive an email back from Nana Baby Home confirming your submission you are officially entered. Spots are first come first serve. Then submit the entry form.   The entry must fulfill all Campaign requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Nana Baby Children’s Home. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Nana Baby Children’s Home.

Odds: The odds of winning depend on the number of eligible entries received. There is also a POPULAR VOTE winner which will be decided by crowd vote (all participants are entered in this category).

Winner Selection and Notification:  One winner (“Winner”) will be selected by the popular vote, by way of “voting tickets” from event goers, to receive a cash prize of $500. This means there is one overall winner, regardless of category, selected by the crowd.

Also, one winner will be selected by a panel of judges for each category: FISH, MEAT – excluding fish, and VEGETARIAN. You must be prepared to submit THREE tacos from each category you have entered to the panel of judges. Entries must be submitted on a plain white paper plate, with no indications of you or your business. Entries will be submitted to the judges in a random order by a member of the Nana Baby team; you will be given a time slot ahead of time to know when to prepare HOT and/or READY tacos. Finally, tacos will be judged out of ten in the following categories: creativity, flavor, presentation, & texture/quality for a total possible score of 40 (per judge). PLEASE KEEP IN MIND THAT TACOS SHOULD BE SMALL (closer to bite size).

Winners will be notified at the end of the event on November 4, 2023. Nana Baby Children’s Home shall have no liability for Winners. Winners or designated individuals must be present to win and receive prize. Receipt by Winners of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNERS (AT Nana Baby Children’s Home SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering this content (e.g., photo, video, text), You understand and agree that Nana Baby Children’s Home, anyone acting on behalf of Nana Baby Children’s Home, and Nana Baby Children’s Home licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this contest, You represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, You will be disqualified at the sole discretion of Nana Baby Children’s Home. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, You shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Nana Baby Children’s Home from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Nana Baby Children’s Home may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

Terms & Conditions: Nana Baby Children’s Home reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Campaign should virus, bug, non-authorized human intervention, fraud, or other cause beyond Nana Baby Children’s Home’s control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign. In such case, Nana Baby Children’s Home may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Nana Baby Children’s Home. Nana Baby Children’s Home reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Campaign or website or violates these Terms & Conditions. Nana Baby Children’s Home has the right, in its sole discretion, to maintain the integrity of the Campaign, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Campaign rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Campaign may be a violation of criminal and civil laws. Should such attempt be made, Nana Baby Children’s Home reserves the right to seek damages to the fullest extent permitted by law. Each Contestant must comply with all applicable rules and regulations of the Virgin Islands Department of Health (all information can be found at https://doh.vi.gov/) including, but not limited to the following: a. Meat must be at 35° F or less before cooking. Coolers with plenty of ice will keep it cold enough. b. After cooking the food, it should be placed in a covered container and maintained at a safe temperature until provided to customers. c. Cleanliness of the cook, assistants, and contestant area is required. d. NO live animals are allowed in the cooking area. This is grounds for disqualification. e. Each team MUST have hand cleaning capabilities. Soap and water or waterless hand cleaner is acceptable. All food preparers and handlers must have a Valid Food Handlers Card from the USVI Department of Health (https://doh.vi.gov/programs/environmental-health/how-obtain-health-card).

Limitation of Liability: By entering, You agree to release and hold harmless Nana Baby Children’s Home and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

Disputes: THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE UNITED STATES VIRGIN ISLANDS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the US Virgin Islands having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.

By submitting your entry form to this contest, You, the Contestant, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
